Terms of Service

BY SUBMITTING A REQUEST TO EVIDENCE MAX, LLC, A WYOMING LIMITED LIABILITY COMPANY (“EVIDENCE MAX”), YOU (“CUSTOMER”) CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THE FOLLOWING TERMS AND CONDITIONS.

1. Fees & Billing

  • Standard Payment Terms: Net 10 business days from the date results and invoice are emailed to your office.

  • Grace Period: An additional 10 business day grace period is provided.

  • Late Fees: Invoices not paid within the grace period are subject to a $25 late fee. An additional $25 will be added every 30 days thereafter.

  • Delinquent Accounts: Invoices not paid within 60 days may be sent to collections, and legal remedies may be pursued.

  • Fee Structure: Fees are per policy researched, as outlined on the Request Form and Fee Schedule. A result confirming no policy in place or no coverage on the date of loss is considered a successful search and will be invoiced accordingly. Only no-hit or inconclusive results will result in a ‘No-Fee’ outcome.

  • Known Policies: To avoid duplicate research and billing, Customers must disclose known policy information at the time of submission. We do not consider policies listed on police reports valid unless explicitly confirmed by the Customer.

  • Extended Research Fees: In rare cases involving older incidents or complex research, additional fees may apply. We will always request written approval before proceeding.

  • Incomplete or Inaccurate Information: If information provided is incomplete or inaccurate, Evidence Max will notify you when possible. If we cannot determine the policy limits or a definitive lack of coverage, we will report the limits as “0” (indicating the policy was not active on the date of loss).

2. Turnaround Times

  • Standard Cases: 3–5 business days for normal liability limit traces.

  • Rush Cases: Prioritized above all non-rush cases. Rush fees are waived if results are not delivered within 3 business days or if results are inconclusive.

  • Hours of Operation: Requests received after 4 PM or on weekends will be processed the next business day.

3. Cancellation Policy

Cancellations are permitted within 24 hours of submission unless work has already been completed. If work has begun, a termination fee may apply.

4. Definitions

  • Insurer: Refers to the carrier, agent, broker, or defendant who is self-insured.

  • Date of Loss: The specific date listed on the Request Form, or any date within a defined loss period.

  • Policy Discovery / Identifying the Insurer: Providing the name, address, and phone number of the insurer covering the defendant on the loss date. If the insurer is no longer active, last known contact info will be provided.

  • Termination: Any cancellation of a request after submission to Evidence Max.

5. Process Overview

  • All searches are performed under the name(s) of the Defendant only. The discovered policy may not necessarily apply to a specific vehicle or property unless otherwise indicated.

  • Customers will be invoiced in accordance with the Fee Schedule regardless of whether the policy covers the specific asset involved.

  • When requesting policy limits for an existing policy, the policy number, claim number, and any available correspondence from the carrier must be provided.

6. Disclaimer

Evidence Max uses reasonable care to obtain accurate, up-to-date information from sources deemed reliable. However:

  • No Warranties: We do not guarantee the accuracy, completeness, or timeliness of any information provided.

  • Use at Your Own Risk: All information and services are provided as-is and as-available.

  • Limitation of Liability: Customer’s sole and exclusive remedy for any damages shall be a refund of the fee paid for the service in question.

  • No Responsibility for Errors: Evidence Max disclaims all warranties, including those of merchantability, fitness for a particular purpose, or negligence.

  • No Incidental or Consequential Damages: Evidence Max shall not be liable for any indirect, incidental, special, or consequential damages, including lost profits or goodwill.

7. Indemnification

Customer agrees to indemnify and hold harmless Evidence Max and its officers, employees, affiliates, contractors, and agents from any claims, damages, losses, or legal costs arising from:

  • a) Customer’s breach of these Terms;

  • b) Customer’s misuse of the services;

  • c) Customer’s provision of false, incomplete, or misleading information.

8. Governing Law

These Terms shall be governed by and interpreted under the laws of the State of Wyoming, without regard to conflicts of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Sheridan, Wyoming.

9. Affirmations & Declarations

  • Customer agrees to use Evidence Max services solely for lawful purposes.

  • Customer affirms that the information provided in the request is accurate, complete, and current.

  • Evidence Max is not responsible for inaccuracies resulting from outdated, false, or incomplete information submitted by the Customer.

  • Customer acknowledges that the information provided by Evidence Max may be based on third-party data and may contain errors, omissions, or outdated content.
